Texas Attorney General Ken Paxton Sunday reportedly filed a lawsuit against the NCAA to prevent transgender women from participating in women’s college athletics.
The lawsuit alleges that “false, deceptive, and misleading” practices were used by the NCAA to market sports events as “women’s competitions,” according to a story on kvue.com.
Paxton argues it is deception to bill a women’s sporting event as such but allow it to be a “mixed-sex competition” where “biological males compete against biological females” because it is a violation of the Texas Deceptive Trade Practices Act.
This lawsuit comes as women’s volleyball players are suing the Mountain West Conference, arguing that the league should not allow transgender players to compete due to fairness and safety risks.
“Consumers do not purchase goods and services associated with women’s sporting events to watch men steal medals and records from female participants,” the lawsuit reportedly states.
“Men competing in women’s sports is inherently unfair and unsafe due to their physiological advantages,” Paxton reportedly said in the suit.
The suit claims that consumers are misled because the NCAA does not disclose which athletes identify as transgender women.
San Jose State, which competes in the Mountain West Conference, allegedly rosters a transgender player. Multiple opponents cited the participation of that player, who’s played NCAA competition for four seasons, as a reason they forfeit games against the Spartans.
The courts are being asked in Paxton’s suit to grant a permanent injunction, or permanently prohibit, the NCAA from allowing biological males to compete in women’s sporting events in Texas and involving Texas teams or to stop the NCAA from marketing it as women’s sports.
Calls to Paxton’s office were not immediately returned Monday morning.
When NCAA President Charlie Baker was asked about transgender student-athletes participating in women’s sports last week in the Senate Judiciary Committee on Capitol Hill, Baker said he was aware of less than 10 transgender athletes out of the 510,000 NCAA athletes.
There has not been a reported incident of any transgender athlete participating in any sport at an NCAA member university in the State of Texas.
